Terms and Condition for Vibrant India Innovation Hub

1. Introduction

Vibrant India Innovation Hub (“we”, “us”, “our”, or “the Hub”) is a platform and initiative dedicated to supporting startups, innovators, and entrepreneurs in India through assessment, evaluation, and facilitation of connections with incubators, accelerators, and venture capital (VC) entities.

These Terms and condition (“Terms”) govern your access to and use of our services, including but not limited to candidate/startup assessments, data submission, evaluation processes, and any related interactions (“Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Services. By using the Services, you represent that you meet these requirements and have the legal capacity to enter into these Terms.

The Services are primarily intended for startups, founders, innovators, or candidates (“Candidates” or “you”) seeking assessment for potential incubation, acceleration, or investment opportunities.

3. Nature of Services

The Hub provides assessment services only. We conduct evaluations of Candidates based on information and data provided by or on behalf of the Candidate.

All charges collected are exclusively for assessment services (e.g., application processing, evaluation, review by experts or panels). There are no guarantees of acceptance, funding, incubation, acceleration, mentorship, business success or any other outcome. We do not represent our self as or associated with any government body.

We do not directly provide incubation space, acceleration programs, funding, or investment. We act as a facilitator that gathers and processes Candidate data for sharing with partnered or associated incubators, accelerators, investor or VCs.

4. Data Collection and Sharing

All personal, business, startup, financial, technical, or other data (“Candidate Data”) submitted by you or collected during the assessment process is gathered solely for the purpose of evaluation and potential referral.

We may share your Candidate Data with third-party incubators, accelerators, venture capital firms, mentors, or evaluation panels (“Partners”) for the sole purpose of assessment, opportunity matching, or due diligence.

By submitting data or applying for assessment, you expressly consent to:

  • The collection, processing, storage, and sharing of your Candidate Data as described.
  • Transfer of your data to Partners (who may be located in India or elsewhere).
  • Use of your data in anonymized or aggregated form for Hub analytics, reporting, or improvement of Services.

We do not sell your personal data. Data sharing is limited to legitimate assessment and opportunity facilitation purposes.

5. Fees and Payment

Fees are charged only for assessment services and are non-refundable once the assessment process begins, except as required by applicable law.

Fees do not include any costs for incubation, acceleration programs, legal services, or investment—those would be separate arrangements directly between you and any Partner.

You are responsible for all applicable taxes on fees.

Refund applicable only for duplicate payment or technical error. Our liability is limited to amount you paid.

6. User Obligations

You agree to:
• Provide accurate, complete, and up-to-date information.
• Not submit false, misleading, or infringing data.
• Comply with all applicable laws, including those related to data protection, intellectual property, and startup representations.
• Not use the Services for any unlawful purpose or to harm others.

7. Intellectual Property

All content provided by the Hub (e.g., assessment frameworks, reports, templates) remains our property or that of licensors.

You retain ownership of your Candidate Data and any intellectual property rights therein, but grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and share it as necessary for providing the Services and as described in Section 4.

we shall have absolute and unfettered discretion in relation to the evaluation, selection, approval, rejection, award, and disbursement of any grant, funding, benefit, or financial assistance under any program.

We shall not be under any obligation, whether statutory, contractual, equitable, or otherwise, to disclose, publish, communicate, or provide any information whatsoever relating to:

  • the status of an application,
  • evaluation criteria or internal assessment,
  • selection or rejection decisions,
  • timelines or dates of award or disbursement,
  • quantum or structure of any funding, or
  • any other related or incidental details.

All such information shall be deemed strictly confidential and proprietary to us

No applicant, participant, or third party shall have any right, claim, or entitlement to demand such disclosure. Participation in the program does not create any legally binding obligation on the Organization to award, disburse, or provide funding of any nature.

To the fullest extent permitted under applicable law, the We shall not be liable for any direct, indirect, incidental, consequential, or special damages, losses, claims, or expenses arising out of or in connection with:

  • non-selection,
  • delay or non-disbursement,
  • partial disbursement, or
  • non-disclosure of any information related thereto.

The applicant expressly waives any right to initiate legal proceedings, claims, or disputes against us in respect of the matters stated herein, except where such waiver is prohibited under applicable law.

In the event of any dispute, the decision Vibrant India Innovation Hub shall be final, binding, and conclusive, and no further correspondence or justification shall be required.

8. Privacy

Your privacy is important. Our handling of personal data is governed by our Privacy Policy  which forms part of these Terms.

9. No Guarantees or Warranties

The Services are provided “as is” and “as available.” We make no warranties, express or implied, regarding:
• Acceptance into any incubator, accelerator, or investment.
• Accuracy or completeness of any assessment.
• Success of any opportunity resulting from the Services.
• Continuous availability or error-free nature of the platform.

We do not promote you to take any financial decision based on our service or our program or any interaction form our side with you

Submission of an application, shortlisting, selection, or payment of any assessment, consultation, or processing fee does not ensure approval or disbursement of funds.

The timeline, tenure, and mode of disbursement are not fixed and are not guaranteed. These factors are determined solely by the respective authority or program guidelines and may vary on a case-by-case basis.

 

The final sanctioned amount, if approved, may be lower than, equal to, or up to the maximum amount indicated under the program.

The funding or disbursement amounts displayed under any program on this website are indicative and represent the maximum potential value available under the respective program. Such amounts do not constitute a guarantee, commitment, or assurance of funding.

10. Limitation of Liability

To the maximum extent permitted by law, the Hub, its affiliates, officers, directors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility of such damages.

Our total liability shall not exceed the fees paid by you for the assessment in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless the Hub and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from:
• Your breach of these Terms.
• Your Candidate Data infringing third-party rights.
• Your violation of applicable laws.

12. Termination

We may terminate or suspend your access to the Services at any time, without notice, for conduct that we believe violates these Terms or is harmful.

Upon termination, your right to use the Services ceases immediately. Sections concerning data sharing, IP, liability, indemnification, and governing law survive termination. 

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the revised Terms.
